Oral statement made by Hr. Howell before the Commities.

My statement is what is set out in my letter

of the #0th. October, 1909. I produce the original agreement

dated the 24th. September, 1895, between myself and Mr. Tatam

(marked A). I produce the promissiory notes for $1,000 and

$500 both dated the 20th. September, 1895, in my favour signed

by John Tatam (marked B and C). I did go down to the Market for

one or two weeks at 4 a.m. as mentioned by Mr. Tatam. I did

call out the orders to facilitate him in his business. This

was done at his request until such time as he could get

assistance. I had nothing further to do with the Butchery from

that time up to the end of 1897. The statement by Tatam that the

business has been continued by me until recently in a modified

form, is not true. The following statement by Tatam is also

untrue:

"The said Howell has thereby cajoled,

"coerced and defrauded petitioner out of his said business,

*and has squeezed himself into same, and Howell has sought to

"destroy and has thus far succeeded in destroying, wrecking, or

*postponing up to date, the petitioner's just rights and honest "proprietary interest in his said business, and has illegally,

"and by trick and device appropriated same to his own purpose".

I also put in a letter dated the 6th. August, 1896, written by Tatam to me (marked D). I sent Tatam a letter on the 22nd. July, 1896, which contained an account showing that the Butchery owed me $2,162.91. This includes the $1,500 which I advanced. On the
